Melanie Szweras and Anastassia Trifonova coauthored the chapter “Canada: Patent Laws and Regulations” published by The International Comparative Legal Guides (ICLG)

In Canada, an action for patent infringement can be brought in either the Federal Court or the provincial superior courts. The Federal Court has jurisdiction in all provinces and territories and allows claimants to seek remedies throughout Canada.
